A state Appeals Court judge agreed to halt the 6-cent-a-gallon charge pending a hearing by the full Appeals Court on Dec. 29 into the state's attempts to force West Lynn and All Star Lecomte Dairy of Somerset to pay. Agriculture Commissioner Gregory Watson had threatened to revoke the operating licenses of the two dealers, who have been balking since July. Although various other challenges to the special levy, aimed at closing the gap between federally-set milk prices and the higher production costs of Massachusetts farmers, have been filed in federal and state courts, the ruling marked the first time any dealer had obtained a temporary stay, Zadeh said.
