Zusammenfassung:The subject of the article is the analysis of the legal situation when under one third party liabil- ity insurance policy the insurance coverage is provided not only for the policyholder, but also for other entities (insured persons). This situation poses a problem for the cover of these entities for damage caused to one another and damage in the relation: policyholder – insured persons. The issue is further complicated by the Civil Code’s recognition of the victim in the third party liabil- ity insurance, who, according to Article 822 §1, is a “third party”, which, at first glance, rules out protection of claims between the insureds in one third party liability insurance contract.In practice, clauses which are Polish equivalents of the “cross liability clause” are used to pro- vide insurance coverage for counterclaims. These clauses are designed to provide the insureds with such protection, “as if a separate policy has been issued for each of them” (fragment of one of the clauses). The addressed issue is complex, but we are trying to present it in an as compre- hensible form as possible, hence the numerous breakdowns and diagrams. It is important for us to ensure that the text has both cognitive and educational value.
