Popis: It is indicated that in modern Ukraine, in the context of its development as a legal state, European integration, evolution of public administration, local self-government reform, development of united territorial communities, development of civil society institutions, administrative reform, ensuring effective administrative and legal regulation of projects of economic development of united territorial communities. It is noted that the projects of economic development of united territorial communities are now extremely important in Ukraine for the further development of united territorial communities, the growth of local budget revenues, increasing the economic independence of united territorial communities, the creation of new quality jobs, and the implementation of the principles of sustainable development at thelocallevel, effective management, development of agriculture, promotion of small business development, as well as development of local self-government and promotion of European integration of Ukraine. The authors agree with the basic content of the definition of the concept of «functions of local self-government bodies», which was expressed by scientists, taking as a basis the construction of the definition of this term as «the main directions of their activity», we will consider in more detail the functions of local self-government bodies that they perform in the field of cross-border cooperation. As a result of the study of Article 13 of the Law of Ukraine (functions of inter-municipal cross-border cooperation), it was found that in Article 13 of the Law of Ukraine «On Cross-Border Cooperation» there is no functional reflection of the powers provided for by this Law and the Law of Ukraine «On Local Self-Government in Ukraine» in terms of formation, activity and exit from the union of Euroregional cooperation. In order to avoid a gap in the regulation of the functions of the subjects of cross-border cooperation of Ukraine, it is proposed to add a new function and set out Article 13 of the Law of Ukraine «On Cross­Border Cooperation» in a new version.
Вказується, у сучасній Україні, в контексті її розвитку як правової держави, євроінтеграції, еволюції публічного управління, реформи місце­вого самоврядування, розвитку об’єднаних те­риторіальних громад, розвитку інститутів грома­дянського суспільства, адміністративної рефор­ми, важливого значення набуває забезпечення дієвого адміністративно-правового регулювання проектів економічного розвитку об’єднаних тери­торіальних громад. Зазначається, проекти економічного розвит­ку об’єднаних територіальних громад нині мають надзвичайно важливе значення в Україні для по­дальшого розвитку об’єднаних територіальних громад, зростання доходів місцевих бюджетів, підвищення економічної самостійності об’єднаних територіальних громад, створення нових якісних робочих місць, впровадження принципів сталого розвитку на місцевому рівні, ведення ефективно­го господарювання, розвитку сільського госпо­дарства, сприяння розвитку малого бізнесу, а та­кож розвитку місцевого самоврядування і спри­яння євроінтеграції України. Автори погоджуються з основним змістом ви­значення поняття «функції органів місцевого са­моврядування», яке висловили науковці, взявши за основу конструкцію визначення даного термі­ну як «основні напрями їх діяльності», детальніше розглянутр функції органів місцевого самовряду­вання, які вони здійснюють в сфері транскордон­ного співробітництва. В результаті дослідження статті 13 Закону України (функцій міжмуніципального транскор­донного співробітництва) виявлено відсутність в статті 13 Закону України «Про транскордонне співробітництво» функціонального відображення передбачених даним Законом та Законом України «Про місцеве самоврядування в Україні» повно­важень в частині утворення, діяльності та виходу з об’єднання єврорегіонального співробітництва. З метою уникнення прогалини врегулювання функцій суб’єктів транскордонного співробітни­цтва України, запропоновано доповнити новою функцією та викласти статтю 13 Закону України «Про транскордонне співробітництво» в новій ре­дакції.
