| Description: | Анализируется понятие ограничение прав с конституционноправовых позиций, обосновывается необходимость разделения в структуре конституционноправого статуса лиц, замещающих государственные должности субъекта Российской Федерации, ограничений конституционных прав и запретов на ненадлежащее выполнение обязанностей. В действующем законодательстве выделяются две группы правовых норм, содержащих ограничения конституционных прав граждан, связанные с полномочиями по государственной должности субъекта Российской Федерации: 1) устанавливающие условия реализации конституционного права 2) устанавливающие изъятие того или иного объема правомочий, входящих в состав права The article analyzes the concept of restriction of rights from the constitutional and legal positions, substantiates the need for separation in the structure of the constitutional and legal status of persons holding public office of the subject of the Russian Federation, restrictions of constitutional rights and prohibitions on improper performance of duties. In the current legislation two groups of the legal norms containing restrictions of the constitutional rights of citizens connected with powers on the state position of the subject of the Russian Federation are allocated: 1) establishing conditions of implementation of the constitutional right 2) establishing withdrawal of this or that volume of the powers which are the part of the right. |
