| Abstract (English): |
The article analyzes mediation in clinical and bioethical disputes in the United States, using Pennsylvania as a leading model. It examines legal and institutional tools -- mediation confidentiality, the MCARE fund, mandatory settlement conferences, and pre-suit programs -- that enable timely, consensual resolution of conflicts over informed consent, medical malpractice, and clinical research. Barriers include fragmented regulation, lack of uniform mediator certification, and a weak settlement culture. The paper proposes a UMA-plus package: national confidentiality standards, strengthened apology laws, and incentives for healthcare providers. [ABSTRACT FROM AUTHOR] |

W artykule przedstawiono zagadnienie mediacji w sporach dotyczących prawa medycznego i bioetyki w Stanach Zjednoczonych, ze szczególnym uwzględnieniem modelu pensylwańskiego. Przeanalizowano mechanizmy prawno-instytucjonalne, tzn. przywilej poufności mediacji, fundusz MCARE, obligatoryjne konferencje ugodowe i programy pre-suit, które sprzyjają szybkiemu, polubownemu zakończeniu sporów dotyczących świadomej zgody, błędów medycznych i badań klinicznych. Ustalono, że do głównych barier korzystania z mediacji należą rozproszone regulacje, brak jednolitej certy- fikacji mediatorów oraz niska kultura ugód. W artykule zaproponowano ukształtowanie pakietu UMA-plus, na który składałyby się: ogólnokrajowy standard poufności, wzmocniona ochrona przeprosin oraz zachęty dla podmiotów leczniczych.
