| Abstract (English): |
The research dealt with a sale that is disputed among jurists, namely the sale of ‘inah. It defined the sale in language and terminology; then the meaning of ‘inah in language dictionaries and books of jurists. Then this research covered the issue of the sale of ‘inah, explaining and describing it. It mentioned the most important forms of this sale, then presented the statements of jurists and their disagreement on that. It also expanded the evidence for those who forbid and permit this sale with the evidence and discussed it. The research ended with stating the prevailing opinion on this sale. تناول البحث بيعا من البيوع المختلف فيها بين الفقهاء، ألا وهو بيع العينة، فعرف البيع في اللغة والاصطلاح؛ ثم معنى العينة في معاجم اللغة وكتب الفقهاء، ثم استوعب هذا البحث مسألة بيع العينة تفسيراً وتصويراً فذكر أهم صور هذا البيع، ثم عرض أقوال الفقهاء وخلافهم في ذلك، كما بسط الأدلة للمانعين والمجيزين لهذا البيع مع وجه الاستدلال، وناقشها، وانتهى البحث إلى بيان الرأي الراجح في هذا البيع، وجاءت الخاتمة بأهم النتائج بعد دراسة هذا البيع.
