Abstract (English): Research Title: A Chapter on Preference from the Book "The Realities of the Foundations in the Science of Islamic Jurisprudence" by Sheikh Hassan bin Hussein bin Muhammad alAmlishi، who died in 964AH. A Study and Critical Edition . Research Objective: To contribute to uncovering the treasures and valuables of Islamic heritage that remain in manuscript form، and to present this precious manuscript to students of knowledge in its finest form، so that researchers and students may benefit from it. This also involves delving into the experience of manuscript editing and becoming acquainted with heritage books، thus gaining new expertise in this distinguished field of knowledge . Research Methodology: The manuscript was edited according to the established scientific methodology for publishing manuscripts، including copying according to the rules of spelling، attributing statements ، clarifying ambiguities ، explaining obscure points، and adding necessary commentary . Results: The manuscript "The Realities of the Foundations in the Science of Islamic Jurisprudence" is a valuable book in the field of Islamic jurisprudence. It contains numerous scholarly issues and abundant benefits. The author، may God have mercy on him، has a unique methodology in his book، arranging the topics in a sound and scholarly manner، largely following the approach of Sheikhs al-Sarakhsi and al-Khabazi. He sometimes begins by presenting his preferred opinion on the matter، which is usually within the Hanafi school of thought. He then presents the opposing view ، followed by the evidence for the preferred opinion ، then the evidence for the opposing view، and finally، a refutation of it. He also pays close attention to definitions ، their explanation ، and the inclusion of qualifications [ABSTRACT FROM AUTHOR]
Abstract (Arabic): عنوان البحث : فصل في الترجيح من كتاب -حقائق الأصول في علم أصول الفقه للشيخ حسن بن حسين بن محمد الأملشي المتوفى سنة 964هـ. دراسة وتحقيق. هدف البحث : المشاركة في الكشف عن كنوز وذخائر التراث الإسلامي التي لا تزال مخطوطة. وإخراج هذا المخطوط النفيس لطلاب العلم في أبهى حلة، حتى يستفيد منه الباحثون وطلاب العلم والخوض في تجرية تحقيق المخطوطات والتعرف على كتب التراث لاكتساب خبرة جديدة في هذا المجال العلمي المتميز. منهج البحث: سلكت في تحقيق المخطوط المنهجية العلمية المتبعة في إخراج المخطوطات من نسخ وفق قواعد الإملاء، وعزو الأقوال، وتوضيحالغامض، وبيان المبهم والتعليق فيما يلزم. النتائج أن مخطوط حقائق الأصول في علم أصول الفقه من الكتب القيمة في علم الأصول، وقد حوى مسائل علمية كثيرة، وفيه فوائد غزيرة، وأن المصنف رحمه الله له منهج خاص في كتابه من ترتيب المواضيع ترتيباً علمياً رصيناً سار فيه على منهج الشيخين السرخسي والخبازي غالباً. وأنه تارة يبدأ عرض المسألة بذكر القول الراجح عنده وغالباً لا يخرج عن قول الأحناف في المسألة، ثم يذكر القول المخالف في المسألة، ثم يذكر دليل القول الراجح، ثم دليل القول المخالف، ثم يرد عليه وله اهتمام بالتعريفات وشرحها، وذكر المحترزات في الغالب [ABSTRACT FROM AUTHOR]
