| Beschreibung: | Modern legal framework for the content of skill level to the State Duma calls for the involvement of experts in the legislative process. Therefore, the current rules provide support of legal examination for the regulation of the legislative process. The current model of regulation of legal examination carried out in the Legal Department of the State Duma of the Russian Federation will require adequate consideration. In the current study, the author proposed to consider the regulation mechanism of the legal examination of the legislative process in the State Duma of the Russian Federation. The author''s use of specifically legal research methods allowed formulating the definition and nature of legal examination carried out by the Legal Department of the State Duma. This study allowed identifying the purpose of legal examination, the initiators and the rules of examination. At the present stage of development of procedural law in the legislative process of the State Duma Regulation remains the primary source of governing in detail the legislative process in the Lower House of the Parliament. The author''s work on the study of norms of the Regulation of the State Duma of the Russian Federation has identified shortcomings in establishing procedures for the appointment and conducting legal examination with the legal control of the State Duma. The author recognizes the legal examination procedure inappropriate and irrelevant. As a result, the author''s detailed study of the rules of the State Duma Regulation concludes that the activities of the responsible committee on the legal assessment of bills must comply with the work of the Legal Department of the State Duma. Regulation of the State Duma contains mandatory directives for the implementation of legal examination at all stages of the elaboration of the draft law. However, the author''s study of the contemporary composition and structure of the State Duma allows affirming that the committees have skilled professionals in various fields of knowledge. The author formulated a proposal to revise the regulation on participation procedures of the Legal Department of the State Duma in the legislative process. The study shows that the activities of the State Duma committees include the necessary components for effective work on the legal assessment of bills. The author proposes to fix in the regulation the principle that allows balancing the imperative participation of the Legal Department of the State Duma in the responsible committee''s activities. A transition to the dispositive method of regulating the relations of legal examinations between the initiator of the bill in the face of the Executive Committee and the executor in the face of the Legal Department of the State Duma. Исследуются содержание и сущность назначения правовой экспертизы, осуществляемой в Правовом управлении Аппарата Государственной Думы. Проводится анализ норм Регламента по применению механизма правовой экспертизы законопроектов. Формулируются выводы о нецелесообразности существующего способа регламентации механизма правовой экспертизы законотворческого процесса, протекающего в парламенте России. Предлагается исключить императивный характер проведения правовых экспертиз в Правовом управлении. |
