| Popis: | Thesis deals with the placement position of woman in legal and ideological point of view in the Islamic world. Koran is in the lead. Individual citations actually justify the position of woman in Islam. On this basis, the family constitutes a fundamental legal institutions. Exposed to the rights pertaining to woman in Islam, the spiritual, social, intellectual and economic situation. In this work the problem of wearing the burqa defines the jurisprudence of the European Court of Human Rights in Strasbourg. Dominating topical example of the ban on wearing the full veil in France. It is defined policy Dress of Muslim women in Europe, especially in Slovenia, by the media and politics. It highlights the area of obstruction of women`s hijab, burqa and niqab. The problem also includes integration within the framework of fundamental human rights and freedoms in an international perspective. An interesting thesis I consider Touareg particular situation Tuareginje covers on the basis of interviews conducted. Final findings on the situation of women in Islam and the issue of the wearing of the burqa as a result of my subjective assessment in the context of theoretical discussions and not be generalized. Diplomsko delo obravnava umestitev položaja ženske s pravnega in ideološkega vidika v islamskem svetu. Koran je pri tem vodilo. Posamezni citati dejansko utemeljujejo položaj ženske v islamu. Na tej podlagi so predstavljeni temeljni družinsko pravni instituti. Izpostavljene so pravice, ki gredo ženski v islamu z duhovnega, družbenega, intelektualnega in ekonomskega položaja. V nalogi problematiko nošenja burke opredeljuje sodna praksa Evropskega sodišča za človekove pravice v Strasbourgu. Dominira aktualen primer o prepovedi nošenja burk v Franciji. Opredeljena je politika oblačenja muslimank v evropskem prostoru, še zlasti v Sloveniji, s strani medijev in politike. Izpostavljeno je področje zakrivanja žensk, hidžaba, burke in nikaba. Omenjena problematika vključuje tudi vpetost v okvir temeljnih človekovih pravic in svoboščin z mednarodnega vidika. Kot zanimivost diplomske naloge smatram Tuarege, zlasti položaj Tuareginj, ki so zajete na osnovi opravljenega intervjuja. Končne ugotovitve o položaju žensk v islamu in problematiki nošenja burke so posledica moje subjektivne ocene v sklopu teoretske razprave in jih ne gre posploševati. |
