| Popis: | This article, devoted to the theme of the Soviet understanding of the state and law, covers the period from the beginning of the 60s to the beginning of the 1960s. before the collapse of the Soviet Union, and is devoted to three issues discussed during this period: the expediency of a single definition of law, the role of state coercion in the formation of law and its class essence. The purpose of the study is to consider changes in the Soviet theory of state and law in the period from the 1960s to the mid-1980s. The scientific novelty of the work lies in highlighting the class-volitional approach to understanding the state and rights. As a result, the works of Soviet lawyers during this period show the processes of moving away from the normative approach to understanding the state and law to modern broad understanding of law. Данная статья, посвященная теме советского понимания государства и права, охватывает период от начала 60-х гг. до крушения Советского Союза, и посвящена трём обсуждавшимся в этот период вопросам: о целесообразности единого определения права, о роли государственного принуждения в формировании права и его классовой сущности. Цель исследования - Рассмотреть изменения в советской теории государства и права в период с 1960-х по середину 1980-х гг. Научная новизна работы заключается в выделении классово-волевого подхода к пониманию государства и прав. В результате в работах советских юристов в указанный период показаны процессы отхода от нормативного подхода к пониманию государства и права к современному широкому правопониманию. |
