| Popis: | Споры, связанные с воспитанием детей, представляют собой особую категорию судебных разбирательств, процессуальные особенности которых требуют пристального внимания исследователей. Это связано как с противоречиями в действующем российском законодательстве, так и со спецификой применения на отечественной почве норм международного права. Основной особенностью категории дел, возбужденных с целью решения сторонами вопросов относительно воспитания детей, является участие в них несовершеннолетних с целью заявления суду их мнения по предмету спора. Авторы исследуют подходы к определению понятия «спор» и «спор о праве», анализируют процессуальные особенности споров, возникающих по поводу определения права на воспитание детей на каждой стадии гражданского процесса, и делают важный вывод относительно процессуальной специфики данной категории споров. Disputes related to the upbringing of children represent a special category of litigation, the procedural features of which require close attention of researchers. This is due both to the contradictions in the current Russian legislation, and to the specifics of the application of the norms of international law on domestic soil. The main feature of the category of cases initiated by the parties for the purpose of resolving issues regarding the upbringing of children is the participation of minors in them with the aim of declaring their views on the subject of the dispute to the court. The authors investigate approaches to the definition of the concept of "dispute" and "dispute about law", analyze the procedural features of disputes arising from the definition of the right to raise children at each stage of the civil process and draw an important conclusion regarding the procedural specifics of this category of disputes. |
