| Popis: | В статье предпринята попытка осмысления некоторых аспектов функционирования и развития судебной власти, в первую очередь ее правосудной функции, в условиях изменившихся внешнеполитических реалий и насущной потребности развития внутригосударственных политико-правовых институтов. Выражается мнение о необходимости продолжения реформирования системы правосудия для придания ей устойчивых значимых признаков цельности и целостности. На примере конституционного правосудия иллюстрируется правомерность постановки вопроса о необходимости разрешения ситуации с возможностью устранения любой судебной ошибки на национальном уровне. Предлагается в результате всестороннего обсуждения выработать для этого институциональную основу и соответствующие ее функционалу механизмы. This article attempts to reflect on certain aspects of the functioning and development of the judiciary, especially its judicial function, in the context of the changed foreign policy environment and the urgent need for the development of domestic political and legal institutions. It argues that the reform of the justice system needs to continue in order to give it lasting and meaningful features of integrity and coherence. The case of constitutional justice is illustrated to illustrate the legitimacy of raising the question and the need to resolve any judicial miscarriage of justice at the national level. It is suggested that, on the basis of an in-depth discussion, an institutional framework and its corresponding functional mechanisms should be developed for this purpose. |
