| Beschreibung: | This article examines the issue of an ambiguous approach to understanding the sign of "mass character" contained in the crime under Part 1 of Article 236 of the Criminal Code of the Russian Federation. Examples of ambiguous interpretation of this feature by the Supreme Court of the Russian Federation are given. The ways of solving the problem of leveling the abstractness of the above term are proposed. В данной статье рассматривается вопрос неоднозначного подхода к пониманию признака «массовости», содержащегося в составе преступления, предусмотренного ч. 1 ст. 236 УК РФ. Приведены примеры неоднозначного толкования данного признака Верховным Судом Российской Федерации. Предложены пути решения по нивелированию абстрактности вышеуказанного термина. |
