| Description: | В статье рассматривается практика рассмотрения дел Конституционным Судом Российской Федерации, посвященных вопросам финансирования судебных экспертиз в арбитражном и гражданском процессе. Вынося определения об отказе в признании не соответствующими Конституции Российской Федерации норм Арбитражного процессуального кодекса РФ и Гражданского процессуального кодекса РФ об основаниях возложения обязанностей по оплате судебных экспертиз за счет средств бюджета либо за счет средств участников соответствующего процесса, Конституционный Суд Российской Федерации не склонен толковать право граждан на судебную защиту в смысле их полного освобождения от уплаты судебных расходов, включая расходы, связанные с проведением экспертиз. The article discusses the practice of considering cases by the Constitutional Court of the Russian Federation on the issues of financing forensic examinations in arbitration and civil proceedings. In issuing Rulings on the refusal to recognize the norms of the Arbitration Procedure Code and the Civil Procedure Code on the grounds for imposing obligations to pay for forensic examinations at the expense of the budget or at the expense of the participants in the relevant process as inconsistent with the Constitution of the Russian Federation, the Constitutional Court of the Russian Federation is not inclined to interpret the right of citizens to judicial protection in the sense of their full exemption from payment of court costs, including costs associated with the conduct of expert examinations. |
