| Popis: | Purpose of work: based on theoretical sources and legislative norms, formulate the doctrinal concept of biometric identification of subjects of private law relations, determine the characteristics inherent in this process, and examine the currently existing methods of biometric identification. Research method: general scientific and specific scientific methods of synthesis, analysis, as well as system, comparative legal and logical methods. Using the synthesis method and the system method, the legal norms regulating the legal regime of biometric personal data, as well as the process of biometric identification of individuals, were studied. Using the analysis method, the features inherent in the process of biometric identification were studied, and its methods currently used were identified. Using the comparative legal method, the provisions of the legislation regulating the identification of participants in civil legal relations were studied. Using the logical method of scientific knowledge, the doctrinal concept of biometric identification of subjects of private law was formulated. Results of the study: the author formulated an original concept of biometric identification, identified the characteristic features inherent in this process, and revealed both the normative and optional nature of its legal regulation. Research novelty: the author formulated a conceptual definition of biometric identification as a communicative process of individualization of individuals participating in private law relations carried out in a digital environment using their biometric identifiers and gave a description of biometric identification as a process regulated by the norms of private law. Целью работы является установление правового содержания биометрической идентификации субъектов частноправовых отношений на основе теоретических источников и норм закона, исследовать существующие в настоящее время способы биометрической идентификации, а также определить характерные для процесса биометрической идентификации признаки. Методы исследования. В работе использованы общенаучные и частноправовые научные методы, методы синтеза и анализа, а также системный, сравнительно-правовой и логический методы исследования правового режима биометрических персональных данных, а также процесса биометрической идентификации физических лиц. Результаты исследования: автором предложено оригинальное понятие биометрической идентификации, выделены характерные признаки, присущие данному процессу, выявлен как нормативный, так и диспозитивный характер правового регулирования биометрической идентификации. Научная новизна: автором сформулировано концептуальное определение биометрической идентификации как осуществляемого в цифровой среде коммуникативного процесса индивидуализации участвующих в частноправовых отношениях физических лиц с использованием их биометрических идентификаторов и дана характеристика биометрической идентификации как процесса, урегулированного нормами частного права. |
