| Beschreibung: | Based on the analysis of legal literature and legislation on the relationship between the concepts of «constitutional court proceedings» and «constitutional justice» in the Russian Federation, several judgments are substantiated in the article: the concepts of «legal proceedings» and «justice» are not well-established and therefore difficult to correlate; the concepts of «constitutional court proceedings» and «constitutional justice» are not well-established and therefore difficult to correlate; the identification of the concepts of «constitutional court proceedings» and «constitutional justice» is not acceptable; the provisions of the Federal Constitutional Law of the Russian Federation «On the Constitutional Court of the Russian Federation» dated July 12, 1994 allow us to assert that there is only constitutional court proceedings in the Russian Federation (Part 3 of Article 3). На основе анализа юридической литературы и законодательства о соотношении понятий «конституционное судопроизводство» и «конституционное правосудие» в Российской Федерации обосновано несколько суждений: понятия «судопроизводство» и «правосудие», а также неустоявшиеся и поэтому трудно соотносимые; «конституционное судопроизводство» и «конституционное правосудие» недопустимо отождествление понятий «конституционное судопроизводство» и «конституционное правосудие»; положения Федерального конституционного закона РФ «О Конституционном Суде Российской Федерации» от 12 июля 1994 г. позволяют утверждать о наличии в Российской Федерации лишь конституционного судопроизводства (ч. 3 ст. 3). |
