| Popis: | Цель исследования: на основе анализа советских и современных источников российской научной литературы и законодательства рассмотреть противоположные точки зрения относительно целей исполнения наказаний осужденных в широком смысле и при исполнении наказаний без лишения свободы в узком смысле; привести авторскую классификацию целей исполнения наказаний без изоляции осужденных от общества, а также средств их достижения. Методы: проведенное исследование базируется на методах анализа и синтеза, сравнительно-правовом и формально-юридическом методах познания. Выводы: представлена авторская классификация целей исполнения уголовных наказаний осужденных без лишения свободы, установлены средства их достижения, сформулированы предложения по внесению изменений в действующее уголовно-исполнительное законодательство. Автором доказана позиция о том, что эффективность деятельности учреждений и органов УИС во многом зависит от однозначности понимания целей исполнения наказаний. The purpose of the study: based on the analysis of Soviet and modern sources of Russian scientific literature and legislation, to consider opposing points of view regarding the goals of the execution of punishments in the broad sense and in the execution of punishments without deprivation of liberty in the narrow sense; give the author's classification of the goals of the execution of punishments without isolation from society, as well as the means of achieving them. Methods: the conducted research is based on the methods of analysis and synthesis, comparative legal and formal legal methods of cognition. Conclusions: the author's classification of the goals of the execution of criminal penalties without deprivation of liberty is presented, the means of achieving them are established, proposals are made for amending the current penal legislation. The author proves the position that the effectiveness of the activities of the institutions and bodies of the penal system largely depends on the unambiguous understanding of the goals of the execution of punishments. |
