Автор настоящей статьи на основе сравнительно-правового анализа советских конституций, иных нормативных правовых актов определяет особенности формирования федеративной формы государственности в первые годы советской власти. В статье раскрываются особенности конституционно-договорной формы РСФСР и нового правового пространства, основанного на принципах демократического централизма и советской демократии. Делается вывод о возможности использования такого опыта в сегодняшних правовых реалиях в целях гармонизации системы законодательства на всей территории Российской Федерации. The author of this article on the basis of a comparative legal analysis of Soviet constitutions and other normative legal acts determines the features of the formation of a federal form of statehood in the first years of Soviet power. The article reveals the features of the constitutional and contractual form of the RSFSR and the new legal space based on the principles of democratic centralism and Soviet democracy. The conclusion is drawn about the possibility of using such experience in today’s legal realities in order to harmonize the system of legislation throughout the Russian Federation. |
